Terms of Service
Last updated: June 30, 2026
Agreement to Terms
PLEASE READ THESE TERMS OF SERVICE (THE "TERMS") IN FULL. THEY GOVERN YOUR ACCESS TO AND USE OF THE SPECTREIQ PLATFORM AND ALL RELATED APPLICATIONS, SERVICES, FEATURES, CONTENT, AND TOOLS. THESE TERMS CONTAIN A BINDING INDIVIDUAL ARBITRATION CLAUSE, A CLASS-ACTION WAIVER, A JURY-TRIAL WAIVER, A LIMITATION OF LIABILITY, A CAP ON DAMAGES, A SHORTENED STATUTE OF LIMITATIONS, AND AN INDEMNIFICATION OBLIGATION THAT AFFECT YOUR LEGAL RIGHTS. BY CREATING AN ACCOUNT, CLICKING "I AGREE," OR USING ANY PART OF THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.
Changes to These Terms
We may update these Terms from time to time. Material changes become effective on the earlier of (a) thirty (30) days after notice through the Service or by email, or (b) the effective date stated in the revised Terms. Non-material changes, including corrections and clarifications, may take effect immediately. Your continued use of the Service after a change becomes effective constitutes acceptance. If you do not agree to a change, your remedy is to stop using the Service and close your account.
Description of the Service
SpectreIQ is an artificial-intelligence-powered platform that assists security professionals, IT teams, enterprises, and organizations across the cybersecurity lifecycle. Depending on your plan, the Service may include:
- AI-powered threat intelligence analysis and detection
- OSINT reconnaissance and attack surface mapping
- Vulnerability scanning, assessment, and remediation tracking
- Compliance mapping, gap analysis, and regulatory framework alignment
- Phishing analysis, malware sandboxing, and forensics investigation
- Penetration testing assistance, red team campaign planning, and SOAR playbook generation
- Security rule generation, MITRE ATT&CK navigation, and report generation
Certain features rely on third-party AI models, cloud infrastructure, and other third-party services. We may add, change, suspend, or discontinue any feature at any time. The Service is a software tool; it does not guarantee any particular outcome, including complete threat detection, breach prevention, regulatory compliance, or elimination of security vulnerabilities.
What SpectreIQ Is Not
SpectreIQ provides software tools only. SpectreIQ is not a law firm, certified cybersecurity consultancy, managed security service provider (MSSP), insurance provider, government agency, or regulatory authority, and the Service is not a substitute for advice from a licensed attorney, certified information security professional, compliance auditor, or qualified incident response team. Output generated by the Service — including vulnerability assessments, threat intelligence reports, compliance analyses, and remediation recommendations — is informational and assistive only. See Section 10 (No Professional Advice) for additional detail.
Eligibility
You must be at least 18 years old to use the Service. You represent that you have not been previously suspended or removed from the Service; are not located in a country or region subject to comprehensive sanctions; are not identified on any restricted-party list maintained by the U.S. government, the United Nations, the European Union, or the United Kingdom; will not use the Service in violation of any export-control or sanctions law; and will not use the Service to conduct unauthorized security testing, develop malware, or cause harm to any system, network, or individual without proper authorization. If you cease to meet these requirements, you must stop using the Service immediately.
Accounts and Security
You must provide accurate, current information when creating your account and keep it updated. You are solely responsible for safeguarding your credentials, API keys, and authentication factors, and for all activity that occurs under your account, whether or not authorized by you, except activity occurring after you have reported unauthorized access to us. You must notify us promptly at info@spectreiq.xyz of any suspected compromise of your account. We may require multi-factor authentication for some accounts and may suspend an account while investigating a suspected security incident. Account credentials may not be shared except as expressly permitted under a written Enterprise Agreement.
Subscription, Billing, and Payment
Subscription Plans
Access to the Services requires an active subscription. Different subscription tiers (e.g., Starter, Professional, Enterprise) provide varying levels of access, usage limits, and features, and may change from time to time. We apply a Fair Usage Policy; abusive or anomalous consumption of computational resources may result in throttling, additional charges, or suspension.
Payment and Renewal
Paid subscriptions are billed in advance and automatically renew at the then-current price unless cancelled before the renewal date. You authorize us and our payment processor to charge your payment method for subscription fees, usage overages, and applicable taxes. Except where required by law, all fees are final and non-refundable, including for partial periods or unused capacity.
Cancellation
You may cancel auto-renewal at any time in account settings or by contacting info@spectreiq.xyz; cancellation takes effect at the end of the current billing period. Cancellation does not automatically delete your data; see Section 13 (Data Retention).
Intellectual Property Rights
Ownership of Services
SpectreIQ retains all right, title, and interest in and to the Services — including its software, models, prompts, orchestration logic, user interface, documentation, and branding — and all related intellectual property rights. You receive only a limited, revocable, non-exclusive, non-transferable license to use the Service under these Terms. No other rights are granted.
Your Content and Data
As between you and SpectreIQ, you retain all right, title, and interest in your data, security configurations, and content submitted through the Services. We claim no ownership interest in your security data or your prompts. By using the Services, you grant SpectreIQ a limited license to process, analyze, and store your content solely to provide, secure, and improve the Services.
AI-Generated Content
Any threat assessments, vulnerability reports, compliance analyses, remediation plans, or other materials generated by our AI systems are provided as assistance tools only and may contain errors, omissions, or inaccuracies. You are solely responsible for reviewing, validating, and ensuring the accuracy and appropriateness of all AI-generated content before relying on it or acting upon it.
Confidentiality and Data Protection
Confidentiality
We treat security assessments, vulnerability data, and organization-specific information as confidential and apply administrative, technical, and organizational safeguards, including encryption, access controls, and secure data storage. Transmission over the internet nonetheless carries inherent risk, and you are responsible for determining whether and how to share sensitive security data with SpectreIQ in light of your organization's security policies and regulatory obligations.
Data Usage
We may use anonymized and aggregated data to improve our Services and AI models. We do not use your organization-specific security data or vulnerability information to train AI models for the benefit of other customers without your explicit consent. No personally identifiable information will be used beyond what is necessary to provide the Services without your explicit consent.
No Professional Advice; No Client Relationship
The Service does not provide legal advice, certified security consulting, compliance certification, insurance underwriting, or regulatory approval, and using the Service does not create a consultant-client relationship, a managed-services relationship, or any other professional relationship between you and SpectreIQ. No communication with the Service, including AI chat features, constitutes privileged professional advice. Threat assessments, vulnerability scans, compliance analyses, and remediation recommendations generated by the Service are starting points for your own evaluation, not professional security opinions, and should be reviewed by qualified cybersecurity professionals before critical decisions are made.
Authorized Use and Testing Responsibility
You are solely responsible for ensuring that all security testing, reconnaissance, vulnerability scanning, and penetration testing activities conducted using the Service are performed only against systems, networks, and assets for which you have explicit written authorization. SpectreIQ makes no representation that any scan result is exhaustive, that any vulnerability assessment is complete, or that any remediation recommendation will eliminate all risk. You acknowledge that unauthorized security testing may violate criminal and civil laws, and you assume all legal responsibility for your use of the Service's offensive security capabilities.
Usage Restrictions
You agree not to:
- Reverse engineer, decompile, or attempt to extract the source code, models, or system prompts of our Services
- Use the Services to conduct unauthorized security testing against systems you do not own or have written permission to test
- Use the Services to develop, distribute, or deploy malware, ransomware, or other malicious software
- Share your account credentials or transfer your license to others
- Use the Services for any unlawful purpose or to violate any applicable regulation, including export-control and sanctions law
- Attempt to circumvent any usage limits, rate limits, or technical security measures
- Use the Services to build, train, or benchmark a competing AI product
- Use the Services to harass, stalk, or harm any individual or organization
Data Retention and Government Requests
Retention
We may retain your data after cancellation for backup, fraud-prevention, legal, tax, and security purposes, consistent with our data-retention schedule and Privacy Policy, after which it may be permanently deleted. If you reactivate within ninety (90) days, we will use reasonable efforts to restore your projects.
Government Requests
We may receive requests from government authorities or law enforcement to disclose account or customer data. Where legally permitted, we will use reasonable efforts to notify the affected user before disclosing data in response to such a request, except where prohibited by law, where notice could endanger someone or compromise an investigation, or in genuine emergencies.
Disclaimer of Warranties
The Services, all AI Output, and all generated materials are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. SpectreIQ does not guarantee complete threat detection, breach prevention, or regulatory compliance.
Our AI-powered tools are assistive technologies and should not be considered a replacement for professional cybersecurity services, managed security operations, or qualified incident response teams. Some jurisdictions do not allow exclusion of certain warranties, so some exclusions may not apply to you.
Limitation of Liability
To the maximum extent permitted by law, SpectreIQ shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, loss of data, security breaches, or regulatory penalties, arising from your use of the Services, including from inaccurate AI Output or failure to identify vulnerabilities or threats. Our total cumulative liability for all claims arising from these Terms or the Service in any twelve-month period will not exceed the greater of the amount you paid SpectreIQ in the twelve months preceding the claim, or US $100.
Indemnification
You agree to defend, indemnify, and hold harmless SpectreIQ from any claims, damages, or expenses, including reasonable attorneys' fees, arising from your use of the Services, your content or data, your violation of this Agreement, your violation of any law, or your security testing decisions made using AI Output.
Term and Termination
This Agreement remains in effect until terminated by either party. You may terminate by discontinuing use of the Services and canceling your subscription. SpectreIQ may suspend or terminate your access for violation of these Terms, non-payment, legal or regulatory requirements, security concerns, or discontinuation of the Service, with notice where reasonably practicable.
Provisions that by their nature should survive termination — including intellectual property, confidentiality, disclaimers, limitation of liability, and indemnification — survive.
Service Availability; No SLA
We aim for high availability but do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, third-party AI provider or cloud-infrastructure outages, cyberattacks, or events beyond our reasonable control. Except where we have executed a separate, written Service Level Agreement with you, the Service is provided without any uptime or response-time commitment.
Electronic Communications and Signatures
You consent to receive notices, disclosures, and agreements electronically, including by email or through the Service. Your electronic acceptance of these Terms — including by clicking "I Agree" or by using the Service — constitutes a valid signature and binding acceptance under applicable electronic-signature laws, to the same extent as a handwritten signature.
Changes to This Agreement
SpectreIQ reserves the right to modify this Agreement at any time. Continued use of the Services after changes become effective constitutes acceptance of the modified Agreement.
